The federal government was given 30 days to respond to the request by the ACLU, which said it was a “critical test case” that could affect President Donald Trump’s immigration agenda.

“We believe that the American people deserve a chance to weigh in on an issue that threatens to upend this country’s immigration policy,” said Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project.

Citizenship and Immigration Services (USCIS) said the directive, which was published on June 20, was necessary to implement the Deferred Action for Childhood Arrivals (DACA) program, announced in 2012 by President Barack Obama.

The ACLU and other immigrant rights groups challenged the new guidance in a lawsuit filed in federal court in Maryland.

Last week, U.S. District Judge George Hazel in Maryland blocked the directive, which would have added requirements for would-be beneficiaries of DACA to be enrolled in college, report work status, maintain continuous employment and to show proof of their “good moral character.”

In his order, Hazel said that the directive was “arbitrary and capricious” because it did not follow the procedural requirements laid out in a U.S. Department of Homeland Security regulation.

The ACLU on Thursday asked the Supreme Court to take up the case.

“In the absence of a meaningful opportunity for comment, it seems to us that the regulation is arbitrary and capricious and warrants review by the Court,” Gelernt wrote in a letter to Supreme Court Chief Justice John Roberts.

In a separate statement, he said: “While USCIS’ (immigration) policy statement was clearly labeled a guidance document, its abrupt announcement, its lack of an opportunity for comment and its failure to follow proper procedures… has put both DACA applicants and the agency itself in an untenable position.”

The government has appealed Hazel’s ruling.
